Terms of Use

1. Purpose of DataStack HQ

DataStack HQ is a platform developed and supported by 34 North Consulting, LLC. It showcases selected dashboards, reporting systems, workflow tools, and custom business applications. Some areas may also provide access points to private systems created for authorized clients.

Public demonstrations are illustrative. They demonstrate concepts, interfaces, and possible workflows and are not production systems, professional advice, or guarantees of a particular result.

2. Permitted Use

You may use the public website and demonstrations for lawful evaluation and informational purposes. You may not:

• Attempt to gain unauthorized access to a workspace, account, system, or data;
• Probe, scan, overload, disrupt, or circumvent security or access controls;
• Upload malicious code, executable content, scripts, or harmful files;
• Upload personal, confidential, regulated, export-controlled, or proprietary information to a public demonstration;
• Violate law, intellectual-property rights, privacy rights, or contractual obligations;
• Scrape, reproduce, resell, or commercially exploit the platform or demonstrations without written permission;
• Misrepresent a demonstration as your own product or as a production-ready system; or
• Use automated means in a manner that creates unreasonable load or interferes with other users.

3. Demonstration Data and Files

Public demonstrations use sanitized sample data unless clearly stated otherwise. Any ability to enter or upload information is provided for demonstration purposes only.

Do not upload sensitive, confidential, regulated, or production information. Public demonstrations may reset, replace, or delete data without notice. We make no promise that demo inputs will be retained, recoverable, private, or suitable for business operations.

We may block, remove, or discard files or data that present a security, privacy, legal, or operational risk.

4. Private Workspaces and Client Services

Access to private client systems is limited to authorized users. Private systems, custom development, consulting services, support obligations, data retention, availability, and security commitments are governed by separate written agreements with 34 North Consulting, LLC.

If these Terms conflict with a signed client agreement regarding a private system, the signed client agreement controls for that system.

5. Intellectual Property

DataStack HQ, its original designs, demonstrations, software, text, graphics, branding, and other content are owned by 34 North Consulting, LLC or used with permission and are protected by applicable intellectual-property laws.

No ownership rights are transferred by allowing access to the website or a demonstration. You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative commercial products from DataStack HQ content except as allowed by law or written agreement. Third-party names, products, and trademarks remain the property of their respective owners.

6. Feedback

If you voluntarily provide suggestions or feedback, you grant 34 North Consulting, LLC permission to use that feedback without restriction or compensation, provided we do not publicly identify you without permission.

7. Availability and Changes

We may change, suspend, reset, restrict, or discontinue any public demonstration or part of DataStack HQ at any time. We do not guarantee that the website or demonstrations will always be available, error-free, compatible with every device, or preserved in their current form.

8. Disclaimers

DataStack HQ and its public demonstrations are provided “as is” and “as available.” To the fullest extent permitted by law, 34 North Consulting, LLC disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and results.

Demonstrations may contain sample calculations, simulated data, incomplete workflows, or features that differ from a final client implementation. You are responsible for independently verifying information before using it for business, financial, legal, operational, or other decisions.

9. Limitation of Liability

To the fullest extent permitted by law, 34 North Consulting, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from use of or inability to use the public website or demonstrations.

To the fullest extent permitted by law, the total liability of 34 North Consulting, LLC arising from the public website or public demonstrations will not exceed the greater of the amount you paid specifically for that use during the preceding twelve months or one hundred U.S. dollars. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

10. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless 34 North Consulting, LLC and its owner, contractors, and service providers from claims, damages, liabilities, and expenses arising from your unlawful use, violation of these Terms, or content or data you submit.

11. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute that is not subject to a separate written agreement will be brought in a court of competent jurisdiction in Georgia, and you consent to that jurisdiction and venue.

12. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted here with a revised “Last updated” date. Continued use after an update constitutes acceptance of the revised Terms.
